LEGAL GUARANTEE OF CONFORMITY

 

All the products sold online in our webshop are covered by the legal guarantee of conformity and of the guarantee against all manufacturing defects. Any defective or noncompliant item must be returned. The COUTELLERIE NONTRONNAISE guanrantees its Nontron knives sold on its website (except for accessories) without limitation of duration, on the conditions defined below. However, the Buyer admits and agrees that the handles of the knives are made from natural materials and could not perfectly match the photos shown on the website.

The guarantee applies to Nontron knives damaged when they are used under normal conditions. This guarantee covers the replacement and the guarantee of the spare parts, the labor costs, or the replacement of the product (if it is not possible to repair it or if the cost of the repair is higher than the value of the knife, the product will be replaced by the same product or by a similar model).

 

To implement this guarantee, the Customer must follow the after-sales procedure set out below.

 

The warranty does not cover the cost of shipping of the knife by the Customer nor those of returning the knife after repairing or replacement. The Customer assumes all the risks linked to the transportation of the Product for both its despatch and its receiving.

 

The guarantee is exclued in case of bad use, negligence, lack of maintenance or for all alteration or modification of the Product by a third person.

 

Regardless of this warranty, the COUTELLERIE NONTRONNAISE remains liable for lack of conformity with the contract under the terms set out in Articles L. 211-4 and following of the Consumer Code and also for the hidden defects of the thing sold in accordance with Articles 1641 and following of the Civil Code. Legal guarantee intervenes under conditions laid down in the law. The rights covered by Articles L. 211-4, L. 211-5, L. 211-12, L. 211-9 and L. 133-3 of the Code of Consumer and articles 1641 and 1648 paragraph 1 of the Code civil apply.

To implement this legal guarantee of conformity, the buyer:

  • benefit from a 24 month delay from the receipt of the good to act

  • can choose between either the repair or the replacement of the goods, Under conditions set out in Article L. 2119 of Consumer Code

  • do not need to provide the proof of the existence of the lack of conformity of the good during the 6 months that follow the delivery of the good. On March 18th 2016, this period is to be increased up to 24 months.

The legal guarantee of conformity applies independently of all granted commercial guarantee.

  • You can decide to implement the guarantee against all hidden defects of the things sold defined in Article 1641 of the Civil Code. In that case, you can either cancel the sales or ask for price reduction in accordance with the Article 1644 of Civil Code.

 

Exceptions

According to the article L.211-8, the Customer can not implement the legal guarantee of conformity in 3 cases:

  • if he knew or could not be unaware of the lack of conformity

  • if he could not ignore the defect at the moment of the conclusion of the contract

  • if the defects are linked to material provided by himself.

 

AFTER-SALES SERVICE

 

Before sending back the defective product, the Customer must contact the COUTELLERIE NONTRONNAISE by e-mail sav@coutellerie-nontronnaise.com , by phone +33 (0)5 53 56 01 55 or on the website www.coutellerie-nontronnaise.com (section contact).

 

The Customer has to send us back the defective knife at the following address COUTELLERIE NONTRONNAISE – Place Paul Bert – 24300 Nontron – France. The following informations must be included in the shipment: return address, phone number, detailed description of the problem.

 

The COUTELLERIE NONTRONNAISE will then advise the Customer if the defective item is covered by the guarantee, if it can be repaired or if it has to be replaced.
